"Posting Services" are provided by Marineplus Locator Service Center [sm] under these Terms of Use. These terms may be changed from time to time by Marineplus.

Purpose of these Terms of Use

These Terms of Use govern your use of the Posting Services.  "Posting Services" are transaction facilitation Services made available by Marineplus Locator Service Center[sm] through internet technology on the Marine-Plus.Com website. "Treasures" are any tangible item Posted on Marineplus for sale or wanted by persons in the Marine Industry or Related Field for the Boating Community, of which you must be a part of.

Your Characteristics

You must be at least eighteen (18) years of age to use the Posting Services. You must accept and agree to comply with these Terms of Use, and agree to the delivery to Marineplus of certain information about you as described below in these Terms of Use by Posting or Answering a Post. Marineplus may deny or restrict your use of Posting Services without notice for any reason Marineplus deems appropriate, including, without limitation, a belief that you will not honor your payment or other obligations with respect to the Posting Services, that you have abused or will abuse the Posting Services, that you have used or will use the Posting Services in violation of applicable law, that you have used or will use the Posting Services for prohibited transactions (described below).

Your Obligation to Pay for Posting Treasures (Not for Merchant Store Subscribers... See Below)

As the Seller, ONLY you are responsible for payment of the fees charged for the use of Posting Treasures/Items For Sale on our site. Fees are only for items that are Sold to help support and improve this much needed site for the Boating Community. Please make use of our many other FREE services within our site.

Seller is solely responsible for delivery of the Treasure to the Buyer and for the condition of Treasure until it reaches the Buyer. You may not ship Treasures to Marineplus. If you attempt to do so, the shipment will be rejected or returned to you at your expense. Marineplus is not liable for any loss or damage to Treasures during shipping.

Seller is solely responsible for collection of any monies for sale of their Treasure.  (Updated 11/21/04... Payments Are Via PayPal)

Marineplus will not have any responsibility for the return of merchandise, the reversal of payment or for any other issue arising from the completed transaction.

By Posting a Treasure For Sale or by Selling a Treasure to A Buyer listed in our "Treasures Needed Alert" Sea Chest, Seller agrees to pay all charges arising from use of the Posting Services based on the Final Sold Price for that Transaction as stated above.  (Updated 11/21/04... Transactions are Solely Between Seller and Buyer and ONLY Pictures Added to a Post will be Invoiced by Marineplus via PayPal to the Seller.)

Information Required from Sellers

If you are a seller of a Treasure (a "Seller"), you consent to, authorize and direct the delivery to Marineplus of the following information about you as submitted by you by your Posting: your name, your phone number, your email address, and other personal contact information stated in each submit form. You further understand that additional information may be required from you in the future in connection with the Posting Services, and you agree to provide such information. By Posting or Responding to a Posted Treasure, you also certify that the information described above as submitted by you to the Site is current and accurate.

Buyer and Seller Responsibility for Connection and Use of Services

You are responsible for obtaining and maintaining all equipment and telephone services necessary to access the Marine-Plus.Com Site. You are also responsible for all charges associated with the connection to the Site; the contents of your electronic transmissions; the confidentiality of your Postings and others; and all transactions undertaken under your Postings. If your Posting security is compromised, you must immediately notify Marineplus.

Buyer and Seller Tax Obligations

You agree to pay all sales, use, value added, personal property or other USA Domestic and International Governmental tax or levy imposed on tangible goods that you purchase from or through the Site.

Prohibited Transactions

You may use the Posting Services for Marine Industry Related transactions between you and residents of the United States and Permittable International Countries. You may not use Posting Services for transactions that involve the sale, lease or license of: time sensitive documents (e.g., theater, concert or airline tickets); intangible items (e.g., palm reading, web design, or services for which delivery cannot be easily verified); information (e.g., bulk mailing lists); real property; club memberships or timeshares; liquor licenses; businesses; mobile homes; firearms; weapons or munitions; pirated software, music or videos; counterfeit items; false identification or documentation; illegal drugs or paraphernalia; embargoed items (e.g., Cuban cigars); human or animal remains or organs; online game accounts; chain letters or pyramid schemes or other items deemed by Marineplus as unsuitable for Posting Services.

Use and Disclosure of Your Information

Data collected by Marineplus that contains identifying information about you will only be disclosed by Marineplus for delivering Facilitation Services, processing cancelled transactions, emailing (Boaters Mailing List), managing its risk or as otherwise required under applicable law. By Use of our Services or in Posting you agree that Marineplus may use the information, as well as your electronic communications and electronic records, as described in these Terms of Use.

Disclaimer

BY POSTING A TREASURE, ANSWERING A POST, SUBSCRIBING OR OPERATING A MERCHANT STORE, YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. MARINEPLUS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SPECIFICALLY, NO WARRANTY IS MADE BY ANY PERSON THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THEY WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE, OR THAT THE QUALITY OF ANY PRODUCTS OBTAINED THROUGH USE OF THE SERVICES WILL MEET YOUR EXPECTATIONS. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

Limitation of Liability

Marineplus shall not be liable for direct, indirect, incidental, special, punitive, exemplary or consequential damages arising from or relating to the use, denial or inability to use the Facilitation Services, the cost of procurement of substituted goods and services, or communications conveyed or transactions entered into through a Posting OR Merchant Store, even if any such person has been advised of the possibility of such damages. Marineplus shall not be liable or responsible for any agreements, whether verbal or written, between you and other users of the Facilitation Services, including Merchant Stores. The above limitations may not apply if your jurisdiction does not allow for the limitation or exclusion of liability for incidental or consequential damages.

No Resale or Commercial Use of Services

Your right to use the Facilitation Services is personal to you. You may not resell or make any commercial use of the Facilitation Services without the express consent of Marineplus or Subscriptions to Merchant Stores. You acknowledge that the contents appearing on the Site may be protected by patents, copyrights, trademarks or other proprietary or personal rights and that the use of such content is governed by the laws which create those rights and provide for their enforcement. You may not use the Facilitation Services to disseminate any message in a broad-based mailing.

Indemnification

You shall indemnify and hold Marineplus, subsidiaries, affiliates, officers, directors, employees, merchants and suppliers, harmless from any and all damages, liabilities, costs and expenses, (including reasonable attorneys' fees) arising from or relating to any third party claim, suit or proceedings associated with your use of the Facilitation Services, violation or breach of these Terms of Use, or any allegation that the information you have provided (1) is factually inaccurate, misleading or deceptive, (2) infringes or misappropriates any copyright, trademark, trade secret or other intellectual property right of any third party, (3) is intended to facilitate a prohibited transaction, or (4) is libelous, defamatory, obscene or pornographic or violates other civil or criminal laws, including those regulating the use and distribution of content on the Internet and protection of personal privacy.

Marineplus is Not a Seller

Marineplus is not a seller of any goods purchased or sold through Treasure Postings on this Site other than it's own Wagner Merchant Store unless Stated In a Merchants Store. Marineplus at no time has or takes legal title to or possession of the goods purchased or sold through Treasure Postings on this Site. Marineplus does not participate in the selection or inspection of any goods and has no responsibility or liability for Seller’s failure to provide goods or for any defects in the goods. The Wagner Merchant Store is operated separately from Marineplus, as is all Subscribed Merchant Stores and is responsible for all it's own Sales and Services it offers.   (Updated 11/21/04... Merchant Stores are Subscribers

Merchant Stores on Marineplus are Subscription users of this site and pay a Monthly Fee Only, not a Posting fee as stated above under 'Your Obligation to Pay for Posting Treasures' for general users. Marineplus at no time has or takes legal title to or possession of the goods purchased or sold through Merchant Stores on this Site, with exception of it's own Wagner Merchant Store. Marineplus does not participate in the selection or inspection of any goods and has no responsibility or liability for any other Merchant Store failure to provide goods and service or for any defects in the goods they sell. The Wagner Merchant Store is operated Separately from Marineplus, as is all Subscribed Merchant Stores and is responsible for all it's own Sales and Services it offers. All Merchant Stores must abide by this 'Terms of Use Policy' as does anyone else using the Marineplus Facilitation Service.  At times, Marineplus 'may assist a Merchant with Selling' but must Post this Information in the Merchants Store to accept responsibility.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Ohio, excluding its conflict of law provisions. By Posting a Treasure or Answering a Post, you irrevocably consent to the exclusive jurisdiction of the courts of the State of Ohio and the federal courts situated in the State of Ohio in connection with any action related to these Terms of Use or use of Facilitation Services.

Entire Agreement

These Terms of Use and the general terms, conditions and legal notices posted on the Site regarding the Facilitation Services constitute the entire agreement between and among you, on the one hand, and Marineplus, on the other hand, relating to the provision of Facilitation Services, and supersede and cancel all prior and contemporaneous agreements, claims, representations and understandings related to the Facilitation Services.

Changes to these Terms of Use

Marineplus may amend these Terms of Use at any time. Any change to these Terms of Use will be effective upon posting of the amended Terms of Use on the Site. If you do not agree to any change posted on the Site, you must discontinue your use of Facilitation Services.

Acceptance of these Terms of Use

By Posting A Post Or Answering A Post, Opening A Merchant Store, you acknowledge and certify that you have read and understand these Terms of Use, and agree to be bound by these Terms of Use. You further understand and acknowledge that you have had the opportunity to seek legal advice regarding these Terms of Use. If you are an individual using Facilitation Services on behalf of a legal entity such as a corporation, partnership, company, etc., you certify that you are authorized to accept these Terms of Use on behalf of such entity.
